The impossibility of late payment fees imposition in the case of late delivery of products sold over the internet

The Public Prosecutor’s Office of the State of Sao Paulo filed a Public Civil Action positing that the assessment of late payment fees on consumers in online purchases without the correspondent penalization of the merchant for the late delivery of the products constitutes a lack of contractual understanding between the vendor and the consumer as respects penalty and thus violates the concept of contractual reciprocity.
