GEO-REFERENCING

In order to bring a higher degree of precision to the real estate transactions, Brazil has adopted as a rule the system of geo-referencing (georreferenciamento). Through this system, a specialized engineer shall provide the exact location and boundaries of each property. However, to grant reliability to such system, the conference of the measures and coordinates by INCRA, the government body who centralizes the information related to rural properties in Brazil, is necessary. 

Therefore, in order to promote the geo-referencing and to update the description of the property in the Real Estate Notary Office, new legal deadlines for inclusion of such geo-referenced description were set and extended, considering that after the previous period set, the owners could no longer execute annotations in the property’s roll. The update of the description of the property in the Real Estate Notary Office shall be granted only after certification from INCRA. 

With the proximity of the deadline, due to the large number of properties to be certified by INCRA, with the purpose of registration of their descriptive geo-referenced, it became notorious that INCRA would not be able to analyze all the descriptions provided in a timely manner. In order to avoid damages to the owners, such as prohibitions from registrations before Real State Notary, the publication of the Decree No. 7620 on the latter November 21, 2011 by the President of Brazil came to extend the deadlines for regularization of geo-referencing of rural properties throughout the country.
