The recently enacted Provisional Measure no. 714/2016 introduces several long-awaited changes to the Brazilian Aeronautical Code regarding foreign participation in Brazilian airline companies. In a clear-cut attempt to lure foreign investments to the economic sector, the changes put forth by the Brazilian Government were very well-received, such as the possibility to increase the foreign capital in Brazilian airlines, which is now limited to forty-nine percent (49%) of the voting capital– and may, in specific circumstances, reach one hundred percent (100%) of the capital.
